Terms of Use

1. Provider and acceptance

These Terms are between Darius Medya Limited Şirketi ("Darius Medya," "we," "us," or "our"), a limited liability company registered in Türkiye, and the person using Ferah ("you").

These Terms cover Ferah's free features, Ferah Pro, and virtual items within the app. The plan, price, and billing information displayed in the store at the time of purchase also form part of that purchase.

At the end of the initial setup, you accept these Terms by checking the boxes labeled "I am 18 or older" and "I have read and accept the Terms of Use and Privacy Policy". If you do not accept them, you must not use Ferah.

2. Not medical advice

Ferah is a motivational app that supports you on your quit-smoking journey. It is not a medical device or treatment; it does not diagnose conditions, recommend treatment, or replace a healthcare professional. Your use of Ferah does not create a doctor-patient relationship or any other healthcare professional relationship between you and us.

Ferah is not an emergency service, and your entries are not monitored by a healthcare professional. If you experience a medical emergency, do not rely on Ferah; contact the emergency services where you are located.

If you are considering using medication or a nicotine product, have severe withdrawal symptoms, or have a health condition, consult your doctor.

3. Estimates and averages

Savings, cigarettes not smoked, time regained, and the timing of health benefits are estimates based on the information you enter and general averages from the cited sources. They are not personal measurements or guarantees; everyone's body is different. The organizations cited as sources have not endorsed or sponsored Ferah. We do not guarantee that Ferah will produce any particular result in quitting smoking, health, or savings.

4. Age

You must be 18 or older to use Ferah.

5. Your right to use Ferah and the rules

Ferah is licensed to you, not sold, subject to your compliance with these Terms. We grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use Ferah on devices that you own or control for personal, noncommercial purposes. All rights not expressly granted remain with us or our licensors.

Except where expressly permitted by law or under the applicable licenses for open-source components:

  • You may not copy, distribute, sell, rent, or create derivative works of Ferah.
  • You may not attempt to extract the source code, reverse engineer Ferah, or circumvent technical protections.
  • You may not attempt to obtain or alter Pro access, purchase verification, the Leaves system, or any other feature through cheating, a modified app, a bot, or automation.
  • You may not disrupt or overload Ferah or the services it uses, or gain unauthorized access to them.
  • You may not remove copyright, trademark, or other rights notices.
  • You may not use Ferah for any unlawful, rights-infringing, or harmful purpose.

You are responsible for the accuracy of the information you enter and for the security of your phone and Apple / Google account. Your data is stored on your phone; if you enable Backup, a copy is written to your own iCloud or Google Drive account. If you do not enable Backup, your data cannot be recovered if you lose your phone or delete the app.

6. Pro membership and payments

  • Ferah's basic features are free. Ferah Pro offers monthly or annual subscriptions and a one-time lifetime purchase. The scope of the plan, the price including taxes, and the billing period are displayed before purchase.
  • Purchases are made through the App Store or Google Play and are subject to the store's terms. In some countries, the store makes the sale in its own name. When you confirm the purchase, payment is charged to your store account. We do not see your payment or card information.
  • Monthly and annual plans continue until you cancel. "Monthly" and "annual" describe the billing period; you have no commitment beyond the paid period. The charge for each new period is collected from your store account at the beginning of that period. The timing of renewal charges and any notice or consent required for price changes are determined by the store's rules and the law where you live. A price increase will not apply retroactively to a paid period.
  • You can cancel your subscription at any time through your store account's subscription settings; the Manage subscription link on the Pro page in Ferah also takes you there. Cancellation takes effect at the end of the paid period, and you can continue using Pro until then. Deleting the app does not cancel your subscription.
  • On a new phone, you can recover your Pro membership using Restore purchases on the purchase screen while signed in to the same store account.
  • If your subscription ends, Pro features are locked again. Records you created in Pro, such as Savings Jar and game records, are not deleted, and you can continue where you left off if you subscribe to Pro again.

7. Withdrawal and refunds

  • Türkiye: Pro is a digital service made available immediately upon purchase confirmation. When the conditions under the Turkish Distance Contracts Regulation are met, there is no right of withdrawal for services performed instantly in an electronic environment or digital content delivered instantly. If those conditions are not met, your right of withdrawal continues to apply.
  • European Union and United Kingdom: The law generally provides a 14-day right of withdrawal. If you request that Pro begin immediately before the withdrawal period expires and give the consent required by law, this right may end to the extent permitted by law, or you may be charged a proportionate amount for the period used.
  • Other countries: The mandatory rules of your country regarding withdrawal, refunds, and the conformity of digital content apply.
  • You may submit refund and withdrawal requests through the store's refund process or by emailing us. The store may be the channel through which payment is refunded; this does not eliminate your statutory rights against us. Your rights regarding defective or nonconforming digital content and services remain reserved in all cases.

8. Leaves, garden, and game

Leaves, seeds, garden decorations, game levels, and stars are in-app virtual items; they do not create ownership or a right to payment. Leaves can be earned only through tasks. They cannot be purchased with money, have no real-world monetary value, cannot be redeemed for cash, and cannot be transferred.

We may change tasks, earning amounts, and garden rules prospectively for legitimate reasons such as security, balance, legal requirements, or improving the app. We will not arbitrarily take back a balance that you earned lawfully; we may correct records resulting from cheating or a technical error. These records are stored on your phone and, if you choose, in your backup. If you delete the app without making a backup, these items will also be deleted.

9. Savings Jar

Savings Jar does not hold real money and is not a payment, savings, or banking service. It is a motivational tool that lets you allocate and track your estimated savings, calculated from the information you enter, toward goals. Amounts in Savings Jar are only numbers stored on your phone; how you save and spend your money is your decision.

10. Sharing and invitations

It is your choice whether to share a badge or your progress or invite someone. You are responsible for the content you share; do not share another person's personal information without their permission.

11. Intellectual property

Ferah's name, design, text, visuals, and software are owned by or licensed to us. The licenses for open-source components in the app are available under Profile > About > Open-source licenses.

12. Updates and the future of the service

  • We may update Ferah for security, operating-system compatibility, legal requirements, bug fixes, or improvements. Some features may require the latest version.
  • We may change or remove free features. During a paid Pro period, we will not materially reduce Pro's core functionality to your disadvantage. If this is unavoidable due to security or legal requirements, we will provide the rights to repair, a price reduction, termination, or a refund as required by law.
  • If we need to discontinue Ferah entirely, we will announce it in the app a reasonable time in advance and give you an opportunity to export your data. Advance notice may not be possible in urgent circumstances, such as a security issue, removal from the store, or a legal requirement.
  • Lifetime Pro means a one-time right to Pro for as long as Ferah remains available and supported, not for the lifetime of the individual. This does not give us the right to arbitrarily shut down Ferah shortly after purchase; if Ferah is permanently discontinued, any refund or other remedies required by law remain available.

13. Warranties and liability

We provide Ferah with reasonable care and skill and in accordance with the functionality described in these Terms and on the purchase screen. To the extent permitted by law, Ferah is provided as is; we do not guarantee that it will operate without interruption or errors on every device, but we will make reasonable efforts to resolve problems. If Ferah does not conform to the contract, you have the rights to have it brought into conformity, receive a price reduction, terminate the contract, receive a refund, or seek compensation under the law where you live.

To the extent permitted by law, we are not responsible for health or spending decisions you make based on information in Ferah, data lost because you did not enable Backup, commercial losses and lost profits that were not foreseeable for personal use, or general outages and failures of services outside our control, such as Apple, Google, iCloud, Google Drive, or your internet connection.

Nothing in these Terms excludes or limits our liability arising from our willful misconduct or gross negligence under the Turkish Code of Obligations (Article 115), our liability for death or bodily injury, any other liability that cannot legally be limited, or your consumer rights. These rights include those under the consumer laws of Türkiye, the European Union, and the United Kingdom, as well as the guarantees under the Australian Consumer Law.

14. Apple and Google

These Terms are solely between you and us; Apple and Google are not parties to them. We, not Apple or Google, are responsible for Ferah's content, maintenance and support, product, consumer, and privacy claims relating to Ferah, and addressing claims that Ferah infringes a third party's intellectual property rights. You must use Ferah in accordance with the App Store or Google Play rules.

If you downloaded Ferah from the App Store, the following also applies:

  • You may use Ferah on Apple devices that you own or control to the extent permitted by the App Store Usage Rules, including through Family Sharing.
  • Apple has no obligation to provide maintenance or support for Ferah.
  • If Ferah fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the price you paid in accordance with its terms. To the extent permitted by law, Apple has no other warranty obligation.
  • Apple's Standard End User License Agreement also applies. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a country that supports terrorism, and that you are not listed on any U.S. government list of prohibited or restricted parties.

15. Deleting your data and ending use

You may export your data at any time through Profile > Export my data, delete it using Delete my account on the same page, or uninstall the app. Deleting your account deletes all Ferah data on your phone, your Ferah backup, and the Apple / Google connection; you must separately cancel any active subscription through the store settings. Your purchase records remain with the store and in our accounting records for the periods stated in the Privacy Policy.

If you seriously violate these Terms—for example, by attempting to obtain Pro through cheating—we may terminate your right to use Ferah and restrict fraudulent Pro access to the extent technically permitted by the store. Except in cases of an urgent security issue or legal requirement, we will first give you a reasonable opportunity to remedy the violation. This does not eliminate your statutory refund or consumer rights.

16. Changes

We update these Terms only for legitimate reasons, such as a change in law, security, a new feature, a technical requirement, or clarifying the text. We will display material changes in the app before they take effect and ask you to accept them again; we will not apply changes retroactively. If you do not accept the new Terms, you can export and delete your data and cancel your subscription.

17. General provisions

  • Force majeure: To the extent affected by an event outside our control that could not be prevented through reasonable measures—such as a natural disaster, war, widespread infrastructure or store outage, or a decision by a public authority—we are not responsible for delays in performing our obligations to the extent permitted by law. This does not eliminate refund or consumer rights relating to payments already made.
  • Severability: If a provision of these Terms is found invalid, the other provisions remain in effect.
  • No waiver: Our failure to exercise a right immediately does not mean that we waive that right.
  • Assignment: We may assign our rights and obligations under these Terms to a person that takes over Ferah, provided that we notify you in advance and do not reduce your rights. You may not assign your rights under these Terms except where permitted by law.
  • Entire agreement: These Terms and the plan information displayed at the time of purchase constitute our entire agreement regarding your use of Ferah. The Privacy Policy is a separate notice explaining how personal data is processed.
  • Language: These Terms are available in Turkish and English and are presented in the app's language. If the versions differ, their interpretation will not reduce your mandatory consumer rights where you live; any ambiguity will be interpreted in favor of the consumer.
  • Copy: You can always access the current version of these Terms through the Terms of Use link on the Profile page. The version and date you accepted are recorded on your phone and can be retrieved using Export my data.

18. Governing law

These Terms are governed by the laws of the Republic of Türkiye. If you are a consumer in Türkiye, your right to apply to the Consumer Arbitration Committee or Consumer Court in your place of residence for disputes remains reserved.

If you live in another country, this choice does not eliminate that country's mandatory consumer-protection rules that cannot be waived by contract. Those rules continue to apply, and you may apply to the competent authorities where you live.
